These Terms of Service ("Terms") are an agreement between NazTrack LLC ("NazTrack," "we," "us") and the church or district that uses NazTrack (the "Customer"), along with each person who uses NazTrack (a "user" or "you"). They cover the NazTrack website and application (the "Service").
By creating an account, using the Service, or subscribing, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information. If you accept these Terms for a church or district, you confirm that you are authorized to do so. Read the Privacy Policy
1. Using NazTrack
- Who can use it. NazTrack is offered to churches and districts in the United States. People outside the United States may use it only on behalf of a church or district based in the United States. Users must be at least 13 years old, and their church or district must authorize their access.
- Your account. Keep your password private and don't share your login. You are responsible for activity under your account. Tell us promptly if you think someone else has used it.
- Who has access. Each Customer decides who in its church or district can use NazTrack and what they can see. The Customer is responsible for keeping those permissions current, including removing access when someone leaves.
2. Your church's records
- They belong to the Customer. Member, giving, attendance, and other records a church or district enters in NazTrack belong to that Customer. We store and process them only to provide the Service, as described in our Privacy Policy. We do not sell them.
- Permission to host them. The Customer gives NazTrack permission to host, copy, process, and display its records as needed to run the Service, provide support, and keep the Service secure.
- The Customer's responsibilities. The Customer is responsible for the accuracy of its records. It is also responsible for having the right to enter them, including any notices or consents required by law, for example for information about children.
- Getting records out. A Customer can export its records using the tools in the Service while its account is active. Our Privacy Policy explains how we keep records after an account ends.
3. Acceptable use
Don't use NazTrack to:
- break the law or violate anyone's privacy or other rights;
- send spam or other unwanted email, or email people who have asked not to be contacted;
- upload viruses or other harmful code, or try to get into accounts or data you aren't authorized to see;
- interfere with the Service, overload it, or get around its security or usage limits; or
- copy, resell, or reverse-engineer the Service, or use it to build a competing product.
Email sent through NazTrack. Churches and districts write the emails they send through NazTrack and are responsible for their content. That includes following anti-spam laws such as CAN-SPAM. We may limit or pause sending to protect email deliverability or stop abuse.
4. Subscriptions and payment
- Fees. Paid plans are billed in advance at the prices shown when you subscribe. Districts subscribe annually. Churches can subscribe monthly or annually. You can pay by check or online through our payment processor, Stripe.
- Renewal. Subscriptions renew automatically for the same term until canceled. Cancellation takes effect at the end of the current billing period.
- Refunds. Payments are non-refundable except where required by law.
- Price changes. We will give at least 30 days' notice before a price change takes effect. The new price applies from your next renewal.
- Late payment. If a payment isn't received or fails, and this isn't resolved after notice, we may limit the account to read-only access or suspend it until payment is made.
5. Our software and your feedback
NazTrack, including its software, design, and content, belongs to NazTrack LLC. These Terms give you the right to use the Service. They don't transfer ownership of it to you. If you send us suggestions or feedback, we may use them without owing you anything.
6. Changes and availability
We work to keep NazTrack available and reliable, but it may sometimes be unavailable for maintenance or reasons outside our control. We may add, change, or remove features. If we remove a feature a Customer relies on in a significant way, we will try to give reasonable advance notice.
7. Important disclaimers
- Not professional advice. NazTrack helps churches keep records and produce reports, including giving statements and financial and tax-related reports. It is not legal, tax, accounting, or financial advice. Each Customer is responsible for reviewing its reports and statements and for meeting its own legal and tax obligations.
- Provided "as is." To the extent the law allows, the Service is provided "as is" and "as available." We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be error-free or uninterrupted.
8. Limits on liability
To the extent the law allows:
- NazTrack is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.
- NazTrack's total liability for any claim relating to the Service is limited to the amount the Customer paid NazTrack in the 12 months before the claim arose.
These limits don't apply where the law doesn't allow them.
9. Ending the agreement
- A Customer can stop using NazTrack and cancel its subscription at any time.
- We may suspend or end access for a user or Customer that seriously or repeatedly breaks these Terms, fails to pay, or puts the Service or other users at risk. Except in urgent cases, we will give notice first and a chance to fix the problem.
- Sections 2 (records), 5, 7, 8, 10, and 11 continue to apply after the agreement ends.
10. Disputes
- Talk to us first. If you have a concern, please contact us first so we can try to resolve it informally.
- Governing law. These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any lawsuit about these Terms or the Service must be brought in the state or federal courts located in Sumner County, Tennessee, and both sides agree to those courts' jurisdiction.
11. Other terms
- Changes to these Terms. We may update these Terms. We will post the new version and change the effective date. For material changes, we will notify account holders by email or in the Service at least 30 days in advance. Continuing to use the Service after a change takes effect means you accept it.
- Entire agreement. These Terms and the Privacy Policy are the full agreement about the Service. If a Customer signs a separate written agreement with NazTrack, that agreement controls where it conflicts with these Terms.
- Other. If part of these Terms can't be enforced, the rest still applies. Not enforcing a term right away doesn't waive it. A Customer may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets.
